1. Introduction and parties
These Terms of Service ("Terms") form a binding agreement between QED Imperium Ltd, a company registered in England and Wales with company number 15499238 and registered office at 8 Wey House, 15 Church St, Weybridge, Surrey, United Kingdom, KT13 8NA
("QED", "we", "us"), and you, the user of our websites and services ("you", "Customer").
QED operates trivia and quiz entertainment events under the brands Quiz Eat Drink, Tardeo de Trivia, and Eureka, together with related websites, mobile applications, booking systems, and dashboards (collectively, the "Services").
By creating an account, making a booking, or attending an event, you agree to these Terms, the House Rules (incorporated by reference), and the Privacy Policy. If you do not agree to all of them, do not use the Services.
2. Definitions
- Event — a trivia, quiz, or related entertainment event organised by QED at a partner venue.
- Venue — a third-party hospitality establishment hosting an Event under agreement with QED.
- House Rules — QED's published Conditions of Admission, conduct rules, and sanctions for Events, available at [URL] and incorporated into these Terms by reference.
- Booking — a reservation for one or more places at an Event, made through the Services, whether or not payment is required at the time of booking.
- Account — a registered user profile on the Services.
3. Eligibility and account
You must be at least 18 years old to create an Account or make a Booking. By using the Services you represent that you meet this requirement.
When you create an Account, you must provide accurate and complete information and keep it up to date. You are responsible for all activity carried out through your Account. If you become aware of any unauthorised use, you must notify us promptly.
We may suspend or close an Account at any time in accordance with section 11 (Termination).
4. Bookings, payment, and tickets
Bookings are made through the Services. A Booking is confirmed once you receive a confirmation email or in-app notification from us.
Where payment is required, it is processed through Stripe using the payment credentials of the Event organiser of record. Prices, capacity, and any additional fees are shown at the point of Booking. By completing payment you authorise us, or the relevant partner operator processing through the platform, to charge the stated amount.
Each Booking entitles the named Customer (and any guests for whom the Customer reserves places) to attend the specified Event at the specified Venue. Bookings are non-transferable to other Events without QED's agreement, except as set out in section 6.
5. Refunds and cancellations
5.1 Cancellation by the Customer
You may cancel a paid Booking up to 24 hours before the Event start time for a full refund. Cancellations made within 24 hours of the Event are non-refundable, except where required by law or where the cancellation is due to circumstances beyond your reasonable control and we agree to refund at our discretion.
Cancellation requests must be made through your Account or by writing to info@quizeatdrink.com.
5.2 Cancellation by QED
If we cancel an Event, you will receive a full refund of the Booking price. We will not be liable for any incidental costs (travel, accommodation, etc.) you may have incurred.
5.3 Refunds following a sanction under the House Rules
Where you are expelled from an Event under the House Rules (Tier B or Tier C — see House Rules), the Booking price for the Event from which you are expelled, and any future Bookings affected by an active ban, will be refunded to your original payment method within 14 days. Drinks, food, and other in-venue purchases made directly from the Venue are not refundable by QED.
5.4 Statutory consumer rights
Nothing in this section limits any non-waivable rights you have under the consumer protection law of your country of habitual residence, including, where applicable, Spanish law (Real Decreto Legislativo 1/2007 and related autonomous community legislation).
6. House Rules and right of admission
6.1 Acceptance of House Rules
By making a Booking and attending an Event, you accept the House Rules, which form part of these Terms. The House Rules describe the conduct expected of Customers at Events, the sanctions that apply for breaches (warnings, expulsion, and bans of up to one season or, in serious cases, permanently), and the appeals process.
6.2 Right of admission
QED reserves the right of admission to Events, exercised in accordance with the applicable Spanish autonomous community legislation on public spectacles and recreational activities, including but not limited to:
- Comunidad Valenciana — Ley 14/2010, de 3 de diciembre, de Espectáculos Públicos, Actividades Recreativas y Establecimientos Públicos, as modified by Ley 6/2018;
- Comunidad de Madrid — Ley 17/1997, de 4 de julio, de Espectáculos Públicos y Actividades Recreativas, and Decreto 163/2008;
- Región de Murcia — applicable autonomous legislation on public spectacles;
and, at national level, Ley Orgánica 4/2015 de Protección de la Seguridad Ciudadana.
The Venue retains its own independent right of admission. QED's right of admission is exercised separately and may be enforced regardless of the Venue's position.
6.3 Cross-brand application
A sanction issued under the House Rules applies across all QED brands (Quiz Eat Drink, Tardeo de Trivia, Eureka) and across all Venues at which QED organises Events. A ban under one brand prevents Booking and attendance at any QED Event under any brand for the duration of the ban.
7. Privacy and data
We process personal data in accordance with the Privacy Policy, including the Banlist Privacy Notice, which describes how data of Customers subject to a sanction is handled. Our processing is governed by the General Data Protection Regulation (Regulation (EU) 2016/679, "GDPR"), the UK Data Protection Act 2018, and Spain's Ley Orgánica 3/2018 de Protección de Datos Personales (LOPDGDD).
You may exercise your data subject rights as described in the Privacy Policy.
8. Intellectual property
All content on the Services — including but not limited to text, graphics, logos, images, quiz questions, slide content, software, brand names ("Quiz Eat Drink", "Tardeo de Trivia", "Eureka"), and the compilation thereof — is the property of QED or its licensors and is protected by copyright, trademark, and other applicable laws.
You may not copy, reproduce, redistribute, or use any of this content for commercial purposes, or to operate a competing event, without our prior written consent. Photographs taken at Events may include images of attendees; by attending you acknowledge that QED may capture and use such images for promotional purposes in accordance with the Privacy Policy.
9. Acceptable use of the Services
You agree not to:
- use the Services in any unlawful manner or in breach of these Terms or the House Rules;
- attempt to gain unauthorised access to any part of the Services, other Accounts, or our systems;
- interfere with, disrupt, or impose unreasonable load on the Services;
- create Accounts using false information, or operate multiple Accounts to circumvent a sanction under the House Rules;
- use the Services to harass, threaten, or abuse our staff, partner Venue staff, or other users.
Conduct in breach of this section may result in Account suspension or termination and, where the conduct relates to an Event, a sanction under the House Rules.
10. Limitation of liability
To the maximum extent permitted by law, QED is not liable for indirect, incidental, special, or consequential losses arising from your use of the Services. Our aggregate liability to you for any claim arising under these Terms is limited to the greater of (a) the amount you paid for the Booking giving rise to the claim, and (b) €100.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law, including non-waivable rights of consumers.
11. Termination
We may suspend or close your Account at any time, with or without notice, for breach of these Terms, breach of the House Rules, or where required by law. Where the closure is the result of a sanction under the House Rules, the sanction tier and duration determine when (if ever) you may re-register.
You may close your Account at any time through your Account settings or by writing to info@quizeatdrink.com. Closure of an Account does not extinguish any active sanction under the House Rules.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified by email to the address on your Account or by a prominent notice on the Services at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.
13. Governing law and jurisdiction
The websites, Accounts, and online Services are governed by the laws of England and Wales.
Events held in Spain are governed by Spanish national law and the applicable autonomous community legislation, including the laws referenced in section 6.2. Spanish consumers retain all non-waivable rights under Spanish consumer protection law (Real Decreto Legislativo 1/2007), regardless of the choice of law above.
For Spanish consumer disputes relating to an Event, the consumer may bring proceedings in the courts of their place of residence, in accordance with Article 6 of Regulation (EC) 593/2008 (Rome I) and Article 18 of Regulation (EU) 1215/2012 (Brussels I bis).
For all other disputes, the courts of England and Wales have exclusive jurisdiction.
